If the Clarity Act fails to advance, future U.S. crypto market-structure legislation could be shaped by Democratic lawmakers who have been sharply critical of digital asset bills. Maxine Waters, Shontel Brown and Elizabeth Warren are among the figures who could gain influence if Democrats win control of key congressional committees.

Why it matters

U.S. crypto legislation could face a tougher path in the next Congress if the Digital Asset Market Clarity Act stalls and Democrats gain control of key committees. CoinDesk reported that Representative Maxine Waters, Representative Shontel Brown and Senator Elizabeth Warren are among the Democratic lawmakers who may have greater influence over any renewed effort to write federal crypto market rules.

U.S. crypto legislation could face a tougher path in the next Congress if the Digital Asset Market Clarity Act stalls and Democrats gain control of key committees. CoinDesk reported that Representative Maxine Waters, Representative Shontel Brown and Senator Elizabeth Warren are among the Democratic lawmakers who may have greater influence over any renewed effort to write federal crypto market rules.

The issue matters because crypto policy in Congress runs through committees that oversee the Securities and Exchange Commission and the Commodity Futures Trading Commission. If committee control changes, the pace, priorities and substance of market-structure legislation could change as well, creating uncertainty for companies seeking clearer federal rules.

Waters, a California Democrat, could return to the top Democratic role leading the House Financial Services Committee if her party controls the House. She has previously worked on stablecoin legislation but has also criticized the Clarity Act, arguing that it would create loopholes and weaken protections for consumers and investors.

Brown could also become more important if Democrats take the House, because the House Agriculture Committee plays a role in CFTC-related crypto oversight. She has opposed major digital asset bills, including the GENIUS and Clarity acts, while saying she could support policy that protects consumers and allows innovation to benefit broadly.

In the Senate, Warren has been one of the crypto industry’s most prominent critics and could gain more leverage if Democrats win the chamber and she leads the Senate Banking Committee. CoinDesk also noted that Senator Michael Bennet may be next in line among Democrats on Senate Agriculture if Senator Amy Klobuchar leaves, adding another lawmaker with a record of voting against crypto policies.

For the industry, the immediate question is whether the Clarity Act can move through its current window. If it does not, any next attempt may depend less on the current Republican push for market-structure rules and more on Democratic concerns over consumer protection, regulatory limits and political conflicts tied to crypto activity.
